Inheritance Act Claims is the first updateable service devoted to claims under the Inheritance (Provision for Family and Dependants) Act 1975. The interrelationship of claims under the 1975 Act and decisions in other areas of practice means that the law is constantly evolving. For example, in assessing claims under section 3(2), practitioners must be aware of the enhanced expectations of spouses following the key ancillary relief cases of White v White (2001) and Lambert v Lambert (2002).
Moreover, in Ghaidon v Mendoza, the anticipated decision of the House of Lords concerning the application of the Human Rights Act 1998 to succession tenancies under the Rent Act (1977), and proposed Government legislation, will all have a significant bearing on claims by cohabitees claiming under the Inheritance Act sections 1(1)(ba) and 1(1A).
