This 3rd edition of Civil Procedure in the Superior Courts contains relativeley few new chapters but its length has increased significantly, reflecting the pace of development in this area.
Since the last edition there have been a number of highly significant ammendments to the Rules of the Superior Courts including an overhall of the rules in Order 84 dealing with applications for judicial review and the ammendment of the rules relating to discovery.
There has been a huge volume of decisions dealing with procedural matters which reflects a growing interest on the part of practitioners and judges in this area. Some of these decisions have identified lacunae and shortcomings in the current Rules and there is a clear case to be made for the introduction of a new set on consolidated and modernised rules to facilitate the efficient, expeditious and just resolution of proceedings.
