Issues of payment provision, time issues and quality control are addressed in this text, with comment, criticism and solutions. The standard JCT 81 with Contractor's Design Form of Contract includes an Arbitration Clause (39) which in the past has generally been left in. The arbitration clause in the design and build contract has now been statutorily deleted and thus we find that this areas may become increasingly more litigious. This book demonstrates the features of Design and Build as a procurement system by way of examples drawn from the author's experiences of such projects over 25 years. It examines how the system can be abused by the employer, his agent or the contractor.
