The Asset Tracing and Recovery Review is an analysis of the law and practice of tracing and recovering assets in the most important jurisdictions globally, looking at the procedures and limitations for following and tracing property and how the transformation or intermingling of fraudulently appropriated assets and the identity or behaviour of intermediaries, recipients and beneficiaries affects the original owners’ rights to recover property.
Particular focus is paid to directors’ and officers’ misappropriation of company funds; fraudulent misrepresentation inducing sale of a company at an inflated price and the fraudulent misuse of funds to which the wrongdoer has legal title to or control of to the detriment of the beneficial owner.
The Asset Tracing and Recovery Review examines civil and criminal remedies available; defences to fraud claims; seizures and obtaining evidence, and fraud in specific contexts such as banking, insolvency and arbitration.
