The twenty-one contributions to this volume by Austrian and Israeli scholars address significant aspects of private law development, some of which are of particular importance to the evolving harmonization and potential codification of a European private law. These authors treat questions of contract law such as a ""flexible system approach"" and problems of mistake, frustration or breach. They also address major issues in modern tort law and the latest reforms in family and inheritance law. The contributors discuss these questions in various comparative and methodological perspectives that point far beyond specific national legal systems. The book also devotes appropriate attention to prominent features of Austrian and Israeli codification processes and to the historical foundations of private law development in Roman, Biblical and Talmudic law.
