The procurement of goods and services by public authorities in the market place has been the object of an ambitious European Community legal programme. It has, however, proven largely ineffective. The objectives of transparency and European-wide competition have not been achieved. This study discusses the impact on Member States of such a programme and the economic, legal and political reasons for its legal failure. Alternative policies are proposed.
