Issues relating to the “older client” form a growing area of practice for private client lawyers. This book brings together the principal issues which affect older clients, including wills, trusts, tax planning, powers of attorney, incapacity and care homes.
The new edition will take into account key developments in the law, including the commencement of the Adult Support and Protection (Scotland) Act 2007, which has made significant changes in relation to powers of attorney.
The book is divided into two parts, looking firstly at issues relating to “forward planning” such as powers of attorney and inheritance tax planning. The book then looks at a range of “rescue remedies” for clients facing immediate issues including the death or incapacity of a family member.
