Italian Constitutional Law in the European Context was born in light of the authors’ experience of English-speaking courses on Italian and European Constitutional Law. It presents topics that are distinctive in contemporary European and global legal discourse: the separation of powers, the protection of rights, the role of constitutional adjudication, the dialogue among constitutional courts, as well as democracy and constitutional identity vis à vis the EU. Many of the solutions that Italian Constitutional Law developed with regard to these constitutional courts across all Western democracies. However, although the Italian Constitutional system shares features and experiences that are common to many legal orders it still retains its own peculiarities.

There are two intended audiences for this book. It has been designed to present colleagues with an overview of how the Italian Constitutional system is embedded in a constitutional and political fabric which has recurrent patterns that are common to many Western countries. The various issues are contextualised from the perspective of the main strains of constitutional thought and includes reference to international literature on the subject.
