The IDS Unfair Dismissal Handbook provides a clear and accurate statement of the law on unfair dismissal. The Handbook covers the legal definition of 'dismissal' and sets out the potentially fair reasons for dismissal, e.g. conduct, capability and 'some other substantial reason'. It then tackles the all-important test of fairness, which determines whether the dismissal is actually fair, and sets out the grounds of automatically unfair dismissal to which that test does not apply. The Handbook also deals with the various exclusions from the right to claim unfair dismissal, explains the various remedies available, including compensation, and discusses the right of employees to receive a written statement of the reasons for dismissal.
