This book explores the management of cross-border inheritance matters under the EU Succession Regulation. Drawing on case law from the Court of Justice of the EU and of domestic courts of Member States, chapters analyse cross-border successions from a practice perspective, whilst applying a critical approach.
Consisting of eminent scholars and international practitioners, contributors to the book evaluate the EU Succession Regulation, as part of the constantly growing body of EU law on judicial cooperation in civil matters. Chapters also examine the Regulation’s interplay with other EU and non-EU instruments and perspectives of non-EU regions, including examples of Scotland, Turkey and the Western Balkans. The book provides a comprehensive analysis of the Regulations'' function and impacts, including the operation of the new instrument - the European Certificate of Succession; capturing current practice and setting out a timely roadmap for future scholarship in the field.
EU Succession Regulation is a valuable resource for scholars and students of private international law, particularly those interested in international succession, comparative private law, family and property law. Judges and practitioners will also benefit from the book’s insights into proper interpretation and application of the Succession Regulation.
