This new title, which is written by an experienced practitioner, is the first book to deal specifically with the subject of the variation of trusts in the broad sense. Although the book contains a detailed analysis of applications under the Variation of Trusts Act 1958, it also deals with other types of application to Court (eg applications for rectification, for the approval of compromises, and for Re Hastings-Bass and Re Benjamin orders), with the use of dispositive powers in trust instruments, and with the voluntary disposition of interests under trusts by the beneficiaries.
As well as dealing with the general principles of the variation of trusts, the book considers special topics including as taxation, the conflict of laws, perpetuities and accumulations, bare trusts and human rights. The book deals with the topic from an international perspective, thus ensuring universal appeal.
