The Section 82 Experience

Section 82 cases cost authorities time and money. Authorities that have a strategy in place to deal with cases, and have trained their staff to act as witnesses, have a greater chance of staving off actions. This pack uses a carefully structured case, starting from the site of the complainant's flat, and following it through the processes and procedures of the magistrates' courts. It aims to help your team achieve awareness of the importance of preparation prior to appearing as a witness, understanding of the procedures in Section 82 hearings, confidence in their effectiveness when acting as witness, even in the face of the solicitor's cross-questioning, and an enhanced possibility of successful defence of the claim.;Produced as part of the training of Walsall MBC's Building Works DSO, the principal mover, the DSO's Operations Manager Phil Pettifer, has now developed an external trainer's pack. Designed for use in small or whole group working, the pack focuses on key training issues: Section 82 itself; the connections between Section 82, Nuisance Orders and the Landlord and Tenant Act 1985; the identification of information-gathering techniques and practices; and development and practice of presentation techniques.
