As with the previous editions it is a major aim of this handbook to explain the law of employment as it applies in Scotland and to emphasise the differences both in the law itself and in its interpretation as between Scotland and England. Although there have been many changes to the substantive law since publication of the second edition in 1996, the authors have sought to retain the structure of the first edition by integrating the relevant developments where appropriate.
This edition includes a new section dealing with the European Convention on Human Rights and its impact on employment law practice and procedures. There are expanded sections on health and safety, discrimination, trust and confidence, hours of work and time off, including the new EC Directive on Organisation of Working Time. Maternity, paternity and parental leave rights are dealt with, and there is a new chapter on the Transfer of Undertakings Regulations and the Acquired Rights Directive.
The new Employment Tribunal rules and procedures ACAS; Unfair Dismissal Arbitration procedure; TUPE Regulations and Employment Relations Bill are also discussed.
